The client crashed his car and ended up blowing well over the legal limit. Police recommended that he be charged with impaired driving in Penticton, and he was facing the loss of his driver’s licence and a potential jail sentence. The client hired Mr. van der Walle, who identified a number of likely constitutional issues with the police investigation. Before the Crown made its charge approval decision, Mr. van der Walle wrote a letter to Crown counsel setting out all of those issues. After reviewing the letter, the Crown decided not to approve any criminal charges. The client had also been served with a 90 day Administrative Driving Prohibition, and Mr. van der Walle successfully challenged that prohibition as well. No charges approved, no criminal record, no trial necessary.
